Freeing slaves in the Confederacy could be seen as a military action against the South. As commander-in-chief Lincoln had the Constitutional authority to take military action.
Because the Constitution could sanction emancipation only as one of the war powers, freeing slaves could only be justified as a means of winning the war and suppressing the Southern rebellion
